OVERVIEW

Welcome to TreeHouse Patterns. The terms "we", "us" and "our" refer to TreeHouse Patterns.

TreeHouse Patterns is a trading name of Adam Jeske, a sole trader operating in the United Kingdom.

TreeHouse Patterns operates this store and website, including all related information, content, features, tools, digital products and services, in order to provide you, the customer, with access to our digital leathercraft patterns and related content (the "Services").

TreeHouse Patterns is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are legally capable of entering into a contract in your country or region of residence.

To use the Services, including browsing our online store or purchasing any digital products we offer, you may be asked to provide certain information, such as your email address, billing information and payment details.

You represent and warrant that all information you provide is correct, current and complete and that you have all necessary rights to provide this information.

You are responsible for maintaining the security of your account credentials and for activity carried out through your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 – OUR DIGITAL PRODUCTS

TreeHouse Patterns sells digital leathercraft patterns and related downloadable content.

All products sold by TreeHouse Patterns are digital downloads. No physical product will be shipped.

Product listings describe the files included with each purchase. Depending on the individual pattern, files may include PDF, DXF, SVG or other digital formats, together with instructions, stitch hole markings, full-size pattern pieces or links to supporting video content.

File formats, dimensions, printing requirements, recommended materials and included instructions vary between products. Please review the individual product description carefully before purchasing.

We make reasonable efforts to ensure that our digital patterns, measurements and product descriptions are accurate.

Minor differences may occur as a result of printing settings, software, equipment, materials or construction methods used by the customer.

Customers are responsible for checking printer scaling, paper size, software compatibility and any other technical requirements stated in the product listing before cutting materials.

Digital content supplied by TreeHouse Patterns remains subject to your statutory consumer rights, including applicable rights relating to satisfactory quality, fitness for purpose and conformity with description.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase.

TreeHouse Patterns reserves the right to accept or decline an order where reasonably necessary, including in cases of suspected fraud, payment failure, pricing errors or technical problems.

Your order is accepted when payment has been successfully processed and the digital product is made available to you.

Please review your order carefully before submitting it because digital products may be supplied immediately after payment.

Your purchase is subject to our Refund Policy.

The licence and permitted use of each digital pattern are stated in the relevant product listing, accompanying files or these Terms.

Unless expressly permitted, purchased digital files may not be resold, redistributed, shared, copied for distribution, uploaded to other websites or platforms, or otherwise made available to third parties.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice.

The price charged will be the price displayed at the time the order is placed and will be shown in your order confirmation.

Applicable taxes may be added to or included in the displayed price depending on your country or region and the relevant tax rules.

Prices displayed in different currencies may vary because of exchange rates, currency conversion or regional pricing.

We may occasionally offer promotions or discounts subject to separate terms.

You agree to provide current, complete and accurate purchase, payment and account information.

You represent and warrant that you are authorised to use the payment method provided and that the information supplied is accurate.

SECTION 5 – DIGITAL DELIVERY

All products sold by TreeHouse Patterns are digital downloads.

No physical item will be shipped.

Digital files are made available electronically after successful payment. Access may be provided through a download link, order confirmation page, email or another digital delivery method provided through our store.

Customers are responsible for providing a valid email address and for ensuring that they have suitable software and equipment to open, print or use the file formats described in the product listing.

Download availability may occasionally be delayed by payment processing, platform issues or other technical problems outside our immediate control.

If a purchased file is missing, corrupted or cannot be accessed because of a problem with the supplied download, please contact us and we will make reasonable efforts to provide a replacement or resolve the issue.

Where digital content is supplied immediately, any loss of a statutory cancellation or withdrawal right applies only where the legal requirements for the customer's prior express consent and acknowledgement have been satisfied.

If those requirements have not been satisfied, your statutory consumer rights remain unaffected.

For UK consumers, the supply of digital content before the end of the normal cancellation period requires express consent to the supply beginning and acknowledgement that the right to cancel will be lost once supply begins.

SECTION 6 – INTELLECTUAL PROPERTY

All content available through TreeHouse Patterns, including but not limited to digital patterns, drawings, templates, instructions, photographs, graphics, text, videos, branding, logos and website content, is owned by TreeHouse Patterns or used under appropriate licence and is protected by applicable copyright and intellectual property laws.

Except as expressly permitted by the licence supplied with a product or stated on the product page, you must not reproduce, redistribute, publish, upload, share, sell, resell or otherwise distribute any digital file purchased from TreeHouse Patterns.

Purchase of a digital product does not transfer copyright or ownership of the design.

All rights not expressly granted are reserved by TreeHouse Patterns.

DIGITAL PATTERN LICENCE

Purchase of a digital pattern grants the customer a limited, non-exclusive, non-transferable licence to use the files in accordance with the licence terms stated on the relevant product page, accompanying documentation or these Terms.

Unless expressly permitted in writing, customers may not:

  • resell the digital pattern files;
  • redistribute or share the files with another person or business;
  • upload the files to another website, marketplace, forum, group or file-sharing service;
  • reproduce the files for distribution;
  • claim the pattern or design as their own;
  • sell, transfer or sublicense the digital files themselves.

Any permission relating to the sale of physical goods made using a pattern will be governed by the licence stated with that particular product.

Where a product listing allows commercial use of finished physical items, this does not grant permission to resell or distribute the digital pattern itself.

SECTION 7 – OPTIONAL TOOLS

You may be provided with access to tools or services offered by third parties as part of the Services.

We do not control all such third-party tools and provide access to them on an "as is" and "as available" basis.

Your use of third-party tools is subject to the terms and policies of the relevant provider.

We may introduce additional features, tools or resources in the future. Such features will also form part of the Services and be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to third-party websites or services, including video platforms, payment providers, software providers or other resources.

We are not responsible for examining or evaluating the content, accuracy, availability or policies of third-party websites.

If you choose to access a third-party website, you do so subject to that provider's terms and policies.

Any concerns regarding third-party products or services should be directed to the relevant third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

TreeHouse Patterns is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make in our store are made directly with TreeHouse Patterns.

By using the Services, you acknowledge that Shopify is not the seller of TreeHouse Patterns products and is not responsible for the digital products supplied by TreeHouse Patterns.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify may collect and process certain personal information in connection with your access to and use of the Services.

Information you provide may also be shared with payment providers and other service providers where necessary to process orders and operate the store.

SECTION 11 – FEEDBACK AND REVIEWS

If you submit reviews, feedback, suggestions, photographs or other content relating to TreeHouse Patterns, you confirm that you have the right to provide that content.

You grant TreeHouse Patterns a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display such feedback for purposes including operating, improving and promoting the Services.

You must not submit unlawful, defamatory, abusive, misleading or infringing content.

We reserve the right to remove content that violates these Terms or applicable law.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be typographical errors, inaccuracies or omissions relating to product descriptions, measurements, pricing, availability or other information.

We reserve the right to correct errors or update information where reasonably necessary.

If a material error affects an order you have already placed, we will take appropriate steps, which may include contacting you, correcting the file or issuing a refund where required.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes.

You must not use the Services to:

  • violate applicable laws or regulations;
  • infringe our intellectual property rights or those of others;
  • distribute malware or harmful software;
  • collect personal information unlawfully;

  • resell, redistribute or unlawfully share our digital products;

Termination does not affect rights or obligations that arose before termination.

Sections relating to intellectual property, licences, liability, governing law and other provisions which by their nature should continue will survive termination.

SECTION 16 – WARRANTIES AND DIGITAL CONTENT RIGHTS

Nothing in these Terms excludes or limits any statutory rights that cannot legally be excluded.

Digital content supplied to consumers is subject to applicable consumer protection law.

Where required by law, digital content must be of satisfactory quality, fit for its ordinary or specifically agreed purpose and as described.

We do not guarantee that every pattern will be suitable for every material, machine, laser cutter, printer, software package or construction method unless that compatibility is specifically stated in the product description.

Results may vary depending on materials, tools, printing accuracy, leather thickness, user skill and construction methods.

SECTION 17 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

To the fullest extent permitted by law, TreeHouse Patterns will not be liable for indirect or consequential losses arising from misuse of a digital pattern, incorrect printing, incorrect scaling, unsuitable materials, incompatible software or equipment, or failure to follow product instructions.

Our liability relating to a purchased digital product will not exclude or restrict any statutory remedy that applies under consumer law.

SECTION 18 – INDEMNIFICATION

To the extent permitted by law, you agree to indemnify TreeHouse Patterns against third-party claims arising from your unlawful use of the Services, infringement of intellectual property rights, unauthorised distribution of digital files or material breach of these Terms.

This section does not reduce or restrict any statutory consumer rights.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

Failure by us to enforce any provision of these Terms does not constitute a waiver of that provision.

These Terms, together with our Privacy Policy, Refund Policy and any product-specific licence terms, form the agreement governing your use of the Services.

Where product-specific licence terms conflict with these Terms in relation to the permitted use of a particular digital pattern, the product-specific licence terms will apply to that product.

SECTION 21 – ASSIGNMENT

You may not transfer or assign your rights under these Terms without our prior written consent.

We may transfer our rights and obligations where reasonably necessary in connection with the operation, restructuring or transfer of the business, subject to applicable law.

SECTION 22 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide the Services shall be governed by and construed in accordance with the laws of England and Wales.

Nothing in these Terms affects mandatory consumer rights or protections that apply to you under the laws of the country or region in which you reside.

Section headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 24 – CHANGES TO TERMS OF SERVICE

We may update these Terms from time to time.

The current version will be published on this website.

Where required by law, material changes will be communicated appropriately.

Changes to these Terms will not remove or reduce rights that have already arisen in relation to a completed purchase where doing so would be prohibited by applicable law.

Your continued use of the Services after an updated version takes effect constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.
